1Eligibility and Registration

• Age Requirement: You must be at least 18 years old to use this Service.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials. All activities under your account are your responsibility.
• Accuracy: You agree to provide accurate and complete information during registration.

2Description of Service

PropertyEnhance provides an AI-powered tool designed to improve the quality, lighting, and appearance of property photographs.

3Intellectual Property Rights

4POPIA Compliance & Cross-Border Data Processing

By uploading media to our Service, you acknowledge and agree that your photos may contain information relating to identifiable properties or individuals (such as street numbers, vehicle registration plates, or personal items).

5Acceptable Use Policy

You agree not to use the Service to:

• Upload images that are defamatory, obscene, or infringe on third-party intellectual property or privacy rights.
• “Deepfake” or create misleading representations of properties that could constitute fraud under the Consumer Protection Act.
• Use any automated systems (bots, scrapers) to access the Service without our written permission.

6Fees and Payment

• Pricing: All prices are listed in South African Rand (ZAR) unless otherwise stated.
• Payments: We use secure third-party payment processors like Paystack. You agree to provide valid payment information.
• Refunds: Due to the digital nature of the Service, refunds are generally not provided once an enhancement has been processed, except where required by the Consumer Protection Act (e.g., in the case of a technical failure on our part).

9The PropertyEnhance Mobile App

These Terms cover the PropertyEnhance camera app for Android and iOS as much as the website. Where this section and an earlier one disagree about the app, this section governs.

9.1 What you may do with it

We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own property photography and that of your employer or clients. You may not resell it, rent it out, reverse-engineer it, or use it to build a competing product.

9.2 The photographs you take

You keep ownership of your photographs. By submitting them you give us permission to store them and to pass them to the services that do the enhancing, for the purpose of returning finished photographs to you and for no other purpose.

You confirm that you are entitled to photograph the property and to have those photographs processed — that you have the owner’s or occupier’s permission where it is needed, and that the photographs do not infringe anyone else’s rights. You are responsible for what you point the camera at, including anything private that appears in shot.

9.3 Credits are not bought in the app

The app spends credits; it never sells them. Credits are purchased on propertyenhance.co.za and are not a purchase made through Apple or Google. A credit is spent when a listing is submitted for enhancing. Credits have no cash value and are not refundable except as set out in our refunds policy.

9.4 What the app cannot promise

The app depends on your handset’s camera, on a working internet connection, and on the enhancing services we use. Not every phone can control its camera precisely enough to shoot proper exposure brackets, and no automatic exposure can rescue a scene whose range exceeds what the camera can record. Photographs are enhanced on a best effort basis and results vary with the room, the light and the shot.

Photographs held only on your phone are your responsibility to look after. We are not able to recover work that was never submitted.

9.5 The app stores

Your agreement is with us and not with Apple or Google. They do not operate the Service, do not enhance your photographs, and have no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms in respect of the iOS app and may enforce them against you.

If the iOS app fails to conform to any warranty Apple is obliged to provide, you may notify Apple and Apple may refund the purchase price of the app, which is nil. Beyond that, Apple has no warranty obligation whatsoever in respect of the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility and not Apple’s.

You confirm that you are not located in a country subject to a United States embargo or designated as a “terrorist supporting” country, and that you are not on any United States list of prohibited or restricted parties.

9.6 Deleting your account

You may delete your account and everything on it from Settings inside the app, or from propertyenhance.co.za/delete-account without installing anything. Deletion takes effect after seven days and is permanent afterwards. Unused credits are forfeited. Records of payments are retained with your account detached from them, as our privacy policy explains.

10Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the South African courts.

11Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via the email address associated with your account or through a highly visible notice on our website.

12Termination

We reserve the right to suspend or terminate your account if you breach these terms or if we suspect fraudulent activity. You may stop using the Service at any time.
